Personal Injury is an area of the law that deals with people being injured by some action or lack of action that was negligent. Our society is held together by "rules of conduct", which help define the "duties" we owe to each other. When someone "breaches" a duty they owe to someone else, and that other person is injured or killed as a proximate cause of the breach of duty, then a case for a "personal injury claim exists.

Types of Personal Injury Cases
Automobile and Motorcycle Accidents
An automobile driven by a middle-aged woman, on her way to work one foggy morning, collided with the trailer of a combination tractor trailer. The tractor trailer rig had pulled out of a side road across the woman's lane of travel so as to be traveling in the direction opposite to that of the injured woman. The trucking company denied liability, arguing that the tractor-trailer had its lights on and that the woman struck the trailer ten feet from the tail end of the fifty-five foot rig, thus indicating that the rig did not just pull out right in front of the injured automobile driver. Despite this less than optimal liability picture, evidence was presented which established that the lights on the trailer did not meet the requirements of the state lighting regulations. Also, eyewitness testimony was used to establish that neither the truck nor the trailer side lights would have been visible to the injured woman.
Results: The $900,000 jury award was ultimately reduced by the jury's finding of 40% causal negligence on the part of the injured woman. After holding the verdict on appeal, the trucking company paid in excess of $600,000, including interest.
Injuries Caused by Defective Products
A client suffered a significant neck injury while playing lacrosse - a club sport at the university which he was attending. After analyzing the facts and mechanics of the injury, a design defect claim was asserted against the manufacturer, assembler and seller of the lacrosse helmet.
Results: Payment in the amount of $880,000.
Civil Rights (Wrongful Arrests/Police Abuse/Inadequate Medical Treatment of Prisoners)
A state prisoner was in a coma. Prior nurses, from the prison's private healthcare corporation, were located. They testified that prison medical records had been altered. An investigation at the prison revealed that a prison guard had used excessive force on the client, a type of constitutional violation, causing bleeding to occur in the area of the prisoner's brain. The prison failed to get the prisoner to an emergency room in a timely manner. Suing under Federal civil rights law, and with the assistance of nationally recognized experts, the case was settled after a global mediation was conducted.
Result: The healthcare corporation paid $3,000,000 and the County paid $1,000,000.
